Another successful outcome for Brandi Abogados in the field of criminal law. The Provincial Court of Alicante has upheld an appeal filed by criminal defense attorney Agustín Brandi and acquitted a 25-year-old man who had previously been sentenced to three years in prison for aggravated assault in a case related to gender-based violence.
The ruling completely overturns the judgment issued by Criminal Court No. 2 of Alicante, which had found the defendant responsible for an alleged assault that took place in August 2025 at the home he shared with his partner.
After reviewing the appeal, the Provincial Court concluded that the evidence presented was insufficient to prove the defendant's responsibility beyond reasonable doubt. As a result, the court ordered his acquittal and set aside the conviction imposed at first instance.
The decision highlights the importance of specialized criminal defense and the rigorous assessment of evidence in criminal proceedings, particularly in cases involving assault allegations, appeals and gender-based violence matters.
